1. General Information Only

The information provided on this website is for general informational, promotional, and purchasing purposes only. Website descriptions, photos, drawings, videos, diagrams, blog posts, specifications, estimates, price lists, social media posts, emails, messages, and other communications are not intended to be complete technical instructions, engineering certifications, airworthiness approvals, legal advice, tax advice, mechanic approvals, inspection signoffs, pilot instruction, or regulatory guidance.

Mini-Max USA may provide product information, technical discussion, builder guidance, recommendations, or support. Any such information is advisory only. The buyer, builder, owner, operator, pilot, mechanic, inspector, or other end user remains solely responsible for independent verification, inspection, assembly, completion, maintenance, registration, certification, testing, training, operation, and legal compliance.

2. Aviation Risk Notice

Ultralight, experimental, amateur-built, plans-built, recreational, and sport aviation activities are inherently dangerous. These activities involve substantial risks, including serious bodily injury, permanent disability, death, property damage, financial loss, third-party claims, and other known or unknown hazards.

Any aircraft kit, part, project, used aircraft, plan set, material, document, component, or technical guidance may require substantial skill, judgment, inspection, assembly, maintenance, adjustment, repair, and independent verification before use. By purchasing from Mini-Max USA, you acknowledge that aviation-related products are not ordinary consumer goods and that their safe use depends on many factors outside Mini-Max USA’s control.

3. Custom Made-to-Order Products

Most Mini-Max USA products are custom made, custom cut, custom fabricated, special ordered, allocated, packaged, or prepared specifically for a particular buyer, aircraft, project, order, or transaction. Once materials are ordered, parts are cut, fabrication begins, plans or documents are issued, items are allocated, or work begins on an order, the order may not be cancellable, returnable, refundable, or exchangeable unless Mini-Max USA expressly agrees in writing.

Lead times, delivery estimates, build schedules, supplier timelines, material availability, freight schedules, and completion estimates are estimates only and are not guaranteed unless expressly stated in a separate signed writing by Mini-Max USA.

4. No Warranty Unless Expressly Stated in Writing

To the fullest extent permitted by law, Mini-Max USA disclaims all warranties, express or implied, including but not limited to any implied warranty of merchantability, implied warranty of fitness for a particular purpose, warranty of airworthiness, warranty of design suitability, warranty of safety, warranty of regulatory approval, warranty of future performance, warranty of completion time, warranty of compatibility, and warranty that any item will qualify for certification, inspection approval, registration, or lawful operation in any jurisdiction.

Unless expressly stated otherwise in a separately signed writing by Mini-Max USA, all goods, aircraft, kits, plans, projects, parts, materials, documents, information, and services are provided AS IS, WHERE IS, WITH ALL FAULTS.

No verbal statement, website description, photo, video, email, text message, social media message, estimate, opinion, informal description, or other communication shall create a warranty, promise, guarantee, certification, approval, or binding representation unless specifically included in a written agreement signed by Mini-Max USA.

5. Buyer’s Independent Responsibility

The buyer is solely responsible for determining whether any product, kit, plan, part, material, service, or information is complete, suitable, compatible, safe, lawful, structurally appropriate, and fit for the buyer’s intended use.

The buyer is solely responsible for inspection, inventory, assembly, fabrication, covering, paint, modification, repair, maintenance, storage, transportation, engine selection, propeller selection, avionics and electronics selection, fuel system selection, weight and balance, center of gravity, control systems, structural integrity, flight testing, pilot training, pilot qualifications, registration, certification, operating limitations, regulatory compliance, and lawful operation of any item or completed aircraft.

Mini-Max USA does not certify or approve any completed aircraft unless expressly stated in a separate signed writing.

6. Product Descriptions, Photos, and Specifications

We make reasonable efforts to describe our products accurately. However, aircraft kits, plans, parts, used items, partial projects, and custom fabricated products may vary. Photos may show optional equipment, prior versions, completed aircraft, customer projects, prototype parts, unavailable components, third-party parts, or items not included with a particular purchase.

Unless expressly listed as included in a written order, invoice, addendum, or signed agreement, items such as engines, propellers, redrives, instruments, avionics, batteries, wiring, electronics, covering, paint, upholstery, additional hardware, transport, assembly labor, certification, registration, and inspection services are not included.

Mini-Max USA may update, modify, improve, substitute, discontinue, or change products, materials, suppliers, specifications, pricing, and availability at any time without prior notice.

7. Used Aircraft, Partial Projects, and Previously Started Builds

Used aircraft, partial projects, previously started builds, used parts, and secondhand materials may be incomplete, damaged, altered, aged, improperly stored, missing components, nonconforming, or previously worked on by persons not affiliated with Mini-Max USA. Mini-Max USA may have limited or no knowledge of prior workmanship, storage conditions, hidden defects, missing items, modifications, repairs, or operational history.

Any estimate of completeness, condition, readiness, missing items, project status, or work remaining is informational only unless expressly stated in a signed writing by Mini-Max USA. The buyer must independently inspect, verify, repair, complete, and determine the suitability of any such item before use.

8. Limitation of Liability

To the fullest extent permitted by law, Mini-Max USA and its owners, officers, directors, employees, agents, affiliates, contractors, licensors, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of use, loss of time, lost profits, loss of business opportunity, diminution in value, shipping or freight expenses, storage costs, hangar costs, mechanic costs, inspection costs, disassembly or reassembly costs, travel costs, or similar economic losses.

To the fullest extent permitted by law, Mini-Max USA’s total aggregate liability arising out of or relating to any product, service, order, transaction, communication, website use, or purchase shall not exceed the amount actually paid by the buyer to Mini-Max USA for the specific item or service giving rise to the claim.

9. Release, Assumption of Risk, and Indemnification

By purchasing from Mini-Max USA, using any product or information provided by Mini-Max USA, or participating in any aviation-related activity involving Mini-Max USA products, the buyer knowingly assumes all risks, known and unknown, arising out of or related to the design, sale, delivery, pickup, transport, storage, assembly, completion, modification, repair, maintenance, inspection, ownership, resale, transfer, testing, and operation of any purchased item or resulting aircraft.

To the fullest extent permitted by law, the buyer agrees to release, defend, indemnify, and hold harmless Mini-Max USA and its owners, officers, directors, employees, agents, affiliates, contractors, licensors, successors, and assigns from claims, demands, lawsuits, liabilities, judgments, settlements, penalties, fines, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to the buyer’s purchase, inspection, assembly, modification, maintenance, transport, storage, testing, ownership, operation, resale, transfer, instruction, demonstration, representations to third parties, misuse of materials, deviation from plans, substitution of components, or downstream use of any purchased item or resulting aircraft.

10. Intellectual Property

All Mini-Max USA plans, drawings, manuals, patterns, dimensions, templates, designs, specifications, technical materials, website content, photographs, graphics, logos, text, documents, and other proprietary materials are owned by Mini-Max USA or its licensors unless otherwise stated.

Purchase of plans, drawings, manuals, templates, or other proprietary materials grants only a limited, personal, non-exclusive, non-transferable, revocable license to use those materials solely for the construction, maintenance, and ownership of one aircraft, unless Mini-Max USA expressly agrees otherwise in writing.

You may not copy, distribute, upload, publish, sell, sublicense, assign, share, transfer, reverse engineer, or commercially exploit any Mini-Max USA proprietary materials without prior written consent from Mini-Max USA. Unauthorized copying, sharing, or distribution may result in legal action, including injunctive relief.

11. Third-Party Products and Components

Mini-Max USA may sell, recommend, discuss, link to, or reference third-party products, engines, propellers, redrives, avionics, instruments, hardware, tools, materials, services, vendors, or suppliers. Mini-Max USA does not control third-party products or services and is not responsible for their design, manufacture, safety, quality, compatibility, availability, pricing, documentation, warranties, delays, or performance.

The buyer is solely responsible for evaluating and verifying the suitability, compatibility, legality, and safe installation or use of any third-party product or service.

12. Regulatory Compliance

The buyer is solely responsible for compliance with all applicable local, state, federal, and foreign laws, rules, regulations, aviation standards, registration requirements, certification requirements, operating limitations, inspection requirements, taxes, duties, tariffs, customs rules, and other governmental requirements.

Mini-Max USA does not guarantee that any kit, part, aircraft, plan, project, or completed aircraft will qualify for any particular category, certification, inspection approval, registration, exemption, operating status, or lawful use.

13. Website Use

You agree not to misuse this website, interfere with its operation, attempt unauthorized access, scrape or copy content for commercial purposes, upload malicious code, violate intellectual property rights, or use this website for unlawful, fraudulent, abusive, or harmful purposes.

Mini-Max USA may restrict, suspend, or terminate website access, refuse service, cancel orders, or take legal action where we believe a user has violated our policies, misused our materials, provided false information, attempted fraud, initiated improper payment disputes, or acted in a way that may harm Mini-Max USA.

14. Errors, Pricing, and Availability

We reserve the right to correct errors, inaccuracies, omissions, pricing mistakes, product descriptions, availability information, shipping estimates, and other content at any time without prior notice. We may refuse, cancel, or modify any order affected by an error, even after an order has been submitted, to the fullest extent permitted by law.

Product availability is not guaranteed. Materials, parts, suppliers, and production capacity may change without notice.

16. Governing Law and Venue

This Legal Notice and any dispute arising out of or relating to this website, Mini-Max USA products, orders, communications, or transactions shall be governed by the laws of the State of South Dakota, without regard to conflict of laws principles.

To the fullest extent permitted by law, any lawsuit or court proceeding arising out of or relating to this website, any purchase, any communication, or any transaction with Mini-Max USA shall be brought exclusively in the state courts located in Pennington County, South Dakota, or, if federal jurisdiction exists, in the appropriate federal court sitting in South Dakota. By using this website or purchasing from Mini-Max USA, you consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenience of forum.

17. No Waiver

Mini-Max USA’s failure to enforce any provision of this Legal Notice or any other policy, agreement, or right shall not constitute a waiver of that provision or right. We reserve all rights and remedies available under law, equity, contract, and applicable policy.
