Under 14 CFR 103.1(e)(1) a powered ultralight vehicle weighs less than 254 pounds empty weight, excluding floats and safety devices which are intended for deployment in a potentially catastrophic situation; the actual empty weight of the finished aircraft determines whether it meets that limit.
Stall speed and other performance figures are reference figures. Under 14 CFR 103.1(e)(4) a powered ultralight vehicle has a power-off stall speed which does not exceed 24 knots calibrated airspeed (about 27.6 mph); the actual stall speed of the finished aircraft determines whether it meets that limit.
Reference empty weight for a finished aircraft; each completed aircraft must be weighed individually.
Part 103 status belongs to the finished aircraft, not to a kit or plans. For a powered vehicle, 14 CFR 103.1(e) requires an empty weight of less than 254 pounds (excluding floats and safety devices which are intended for deployment in a potentially catastrophic situation), a fuel capacity not exceeding 5 U.S. gallons, that it is not capable of more than 55 knots calibrated airspeed at full power in level flight, and a power-off stall speed which does not exceed 24 knots calibrated airspeed. These depend on the completed aircraft. Mini-Max USA does not certify, and cannot guarantee, that any completed aircraft qualifies as an ultralight vehicle.
